DMCA Policy

Overview

Mile High Software Solutions LLC ("we", "us", or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using Focal Point Productivity ("the App") if such claims are reported to our Designated Copyright Agent.

Filing a DMCA Notice

If you believe that content available through Focal Point infringes your copyright, please send a written notice to our Designated Agent containing the following information:

1. Identification of the copyrighted work: Identify the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
2. Identification of the infringing material: Identify the material you claim is infringing and provide enough information for us to locate it (e.g., username of the account, description of the content, date shared).
3. Your contact information: Include your name, address, telephone number, and email address.
4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Accuracy statement: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
6. Signature: Your physical or electronic signature.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our Designated Agent containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or Denver, Colorado if you are outside the United States), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the original party does not file a court action within 10-14 business days, we may restore the removed material.

Repeat Infringer Policy

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the App and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Misrepresentation Warning

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
